Practice Areas & Cases Commonly Handled at Our Green Bay Office

Personal injury and criminal cases are the types we probably handle most often at our Green Bay office.  Below is some info that may be helpful if you have either a personal injury or criminal case.

Personal Injury Cases in Green Bay: the Basics

Green Bay residents typically are awarded or reach a settlement for three to ten times more money with our legal counsel than without it, but personal injury cases are complex, and every case is different.  Some need-to-know points:

  • For car, truck, or motorcycle accident cases it’s important to know that Wisconsin is a fault-based state. You can only bring a personal injury case if you are determined to be less than 51% at-fault.
  • Wisconsin is also a comparative-negligence state. The amount of your claim will be reduced by the amount of fault the defense successfully assigns to you. For example, if you’re found to be 30% at-fault and initially receive a $100,000 award, then you would ultimately only receive $70,000. That means one of the first things we must do is help you determine whether you can prove the at-fault party was negligent, and that the negligence was the reason for your injuries.
  • In Wisconsin the statute of limitations for personal injury claims is three years. That’s how long you have to file a claim after your accident or injury. The earlier you can file the better, because that gives your attorneys more time to build a case, and it reduces the chances that you will make mistakes or forget things.
  • The average contingency fee in Green Bay is around 33.33%.
  • The court requires every attorney to provide his or her fees to the clients in writing before the case begins. At the conclusion of the case, the attorney must provide the client with a written statement specifying the amount recovered, if any, the amount to which the client is entitled, and how that amount was determined.
  • We can help you with creditors while your case is in-progress. We can also file insurance claims on your behalf.
  • 92% of personal injury cases are settled out of court. If your case goes to trial it will be heard at the Brown County Circuit Court located at 100 S Jefferson St. in Green Bay, WI.

Criminal Cases in Green Bay

Have you been or charged with a crime in or near Green Bay?  If so, here are some important items to know.

  • Once you ask for an attorney any interrogation should come to a close. You may also want to state verbally your right to remain silent (“plead the Fifth”) at any point during the arrest process.
  • If you’re involved in a first-time DWI or DUI offense your case will be heard at the Green Bay Municipal Court at 330 S. Jefferson St., Green Bay, WI.
  • Other criminal matters are heard at the Brown County Circuit Court at 100 S. Jefferson St., Green Bay, WI.
  • There are four types of bail in Wisconsin: (1) If you are a first-time offender accused of a non-violent misdemeanor, an attorney may be able to get you released on recognizance. (2) You may also be offered a signature bond, in which you sign a document stating you’ll pay a certain amount if you fail to appear in court. (3) You may be allowed to have a relative or friend post a 10% surety bond. (4) You may have the option of a cash bond. As of this writing, there is not a for-profit bail bond industry in Wisconsin.

Hiring a private criminal attorney (rather than a public defender) usually gives you the best chance of going free and of minimizing life disruptions.

Each of our attorneys has gone above and beyond, and has taken steps to increase his or her expertise. For example, one of our defense attorneys, Corey Mehlos, has studied advanced DNA testing theory with one of the nation’s leading DNA experts, which has helped both with post-conviction defense and with achieving acquittals. Once he even turned a list of 17 felony charges into no felony charges at all. You’ll be in equally good hands with any of our Green Bay attorneys who handle criminal cases.

Beyond Expectations

My husband had never been in any legal trouble before and we didn’t know what to do or what the process was. Attorney Kaehne was very upfront and willing to explain every step of the way. My husband can be very skeptical when it comes to trusting people with his best interest, but Attorney Kaehne always remained professional and helpful. My husband was facing the possibility of years in prison and Attorney Kaehne was able to get the matter dismissed. He will always be our first choice!
