Dog Bites and Injuries

Never go into a Courtroom Alone!

Many people love dogs, but that doesn’t change the fact that dog bites can result in severe injuries, disfigurements, and complications. If you’ve been bitten by a dog you have the right to be compensated for your damages.

Often you can make the claim against the dog owner’s homeowner’s insurance company (if he or she is a homeowner). That company will do its best to reduce its liability, of course. Always speak to a qualified dog bite attorney before speaking to an insurance company. Wisconsin dog bite cases are strict liability cases, but the insurance company can still mount a comparative negligence defense, which can reduce your claim.

Filing suit will not necessarily result in the death of the dog.

Some of our clients worry that trying to claim damages will harm the dog. Others want the dog put down.

Either way, filing your claim will not necessarily save the dog or result in the dog’s death. A dog may be put down by court order only if you make the request of the court. The court will then order the humane death of the dog only if:

  1. The dog caused two serious injuries on two separate occasions.
  2. The owner of the dog was aware of the first injury when the second injury took place.

It’s best to move quickly on a dog bite case.

Dog bite claims carry three-year statute of limitations, but it’s unwise to wait that long to act. Often it’s best to start talking to an attorney as soon as you’ve received medical care for the injury. Always seek care from a qualified professional: Don’t handle your dog bite only with first aid.

As time passes witnesses become harder to contact, evidence becomes harder to find, and claims become muddied. The homeowner’s insurance company will also try to pressure you to accept settlements that may not be fair, sign documents that may weaken your claim, or make statements that could reduce the insurance company’s liability.

Having an attorney doesn’t necessarily mean the case will drag on for years or go to trial. It could mean a swifter resolution, insofar as the insurance company finds it harder to ignore or coerce you. It also means avoiding mistakes that may affect you financially.

You’ll recover more for your dog-bite injuries with an attorney.

Working with one of our dog bite attorneys is risk-free. We work on contingency, which means we don’t get paid until your claim gets paid.

You’re likely to recover four times as much by working with an attorney, and you’ll come out ahead even after paying your legal fees.
