U-Visas and the Violence Against Women Act (VAWA)

Never go into a Courtroom Alone!

In 1994, the United States Congress passed the Violence Against Women Act.  Under this Act, if you are the spouse, child or parent of a United States citizen or lawful permanent resident and can demonstrate or prove that you have been the victim of domestic violence, you may be able to obtain lawful permanent residency.  The abuse suffered can include: physical, sexual, psychological, emotional, and/or economic abuse.  There does not have to be police contact or an arrest of the US citizen or resident.  It is important to note that although the Act is called the Violence Against Women Act, persons of all genders may qualify Visa if abuse is proven.  The U-Visa was created in 2000 by Congress with the Victims of Trafficking and Violence Protection Act.  Its purpose was to strengthen the ability of law enforcement and prosecuting agencies to pursue charges related to domestic violence, sexual assault, human trafficking as well as other crimes.  Additionally, it was created to help the victims of these crimes.  The idea was to provide a method of obtaining temporary immigration status for victims of certain crimes, providing they assist prosecution and law enforcement agencies with charging and convicting the perpetrators.

Being a victim of domestic abuse is scary and traumatizing.  It is important to know that if you are the victim of domestic abuse, you can apply for either of these benefits without your abuser’s assistance or knowledge.  Contacting an experienced immigration attorney can be an important first step in keeping you safe and procuring a valid visa.  If granted a visa, you will legally be able to work in the United States.  Additionally, a visa is one way in which you can become a lawful permanent resident and eventually a United States citizen and can also include your minor children.

Beyond Expectations

My husband had never been in any legal trouble before and we didn’t know what to do or what the process was. Attorney Kaehne was very upfront and willing to explain every step of the way. My husband can be very skeptical when it comes to trusting people with his best interest, but Attorney Kaehne always remained professional and helpful. My husband was facing the possibility of years in prison and Attorney Kaehne was able to get the matter dismissed. He will always be our first choice!
