What is the Violence Against Women Act (VAWA)?

In 1994, the United States Congress passed the Violence Against Women Act.  Under this Act, if you are the spouse, child or parent of a United States citizen or lawful permanent resident and can demonstrate or prove that you have been the victim of domestic violence, you may be able to obtain lawful permanent residency.  The abuse suffered can include: physical, sexual, psychological, emotional, and/or economic abuse.  There does not have to be police contact or an arrest of the US citizen or resident.  It is important to note that although the Act is called the Violence Against Women Act, persons of all genders may qualify for a Visa if abuse is proven.

What is a U-Visa?

The U-Visa was created in 2000 by Congress with the Victims of Trafficking and Violence Protection Act.  Its purpose was to strengthen the ability of law enforcement and prosecuting agencies to pursue charges related to domestic violence, sexual assault, human trafficking as well as other crimes.  Additionally, it was created to help the victims of these crimes.  The idea was to provide a method of obtaining temporary immigration status for victims of certain crimes, providing they assist prosecution and law enforcement agencies with charging and convicting the perpetrators.
