What is consular processing, in terms of immigration?

Consular processing is the legal process to becoming a lawful permanent resident (green card holder) while in your home country.  In order to be eligible for consular processing, you must have an approved visa from a United States citizen or lawful permanent resident family member, or employer first.  The family member must be an immediate relative or qualify as a one of the family preference categories.  Immediate relative visas are available for the spouse, unmarried children, and parents of United States citizens.  The family preference categories are:

  • Unmarried adult sons or daughters over the age of 21 of United States citizen;
  • Spouses and unmarried children under the age of 21 of lawful permanent residents;
  • Unmarried adult sons and daughters of lawful permanent residents;
  • Married sons and daughters of any age of United States citizens; and
  • Brothers and sisters of adult United States citizens.

How long does consular processing take?

Consular processing takes approximately 6-12 months for an immediate relative visa to become available. This timeframe can vary substantially depending on the current climate of the government agencies processing the applications.  Unfortunately, it takes much longer for family preference category visas to become available.  After a visa becomes available, you will have to appear for an interview at the consular office in your home country.  The consular office will then decide whether you will be granted residency in the USA (a green card).  If you are granted permanent residency, you will be able to legally enter and reside in the United States as a lawful permanent resident.
